Charge proceeds against man in son's ATV death

A judge has ruled prosecutors can proceed with a charge against a man whose 5-year-old son died in an ATV accident in June in Logan County.

 STERLING, Colo. (AP) - A judge has ruled prosecutors can proceed with a charge against a man whose 5-year-old son died in an ATV accident in June in Logan County.
 
     The Sterling Journal-Advocate reports (http://bit.ly/Ygp3e5 ) the judge expressed sympathy for Jeremy Rupp but ruled this week that prosecutors have presented enough evidence to proceed with a charge of negligent child abuse causing death against him. Trial is set for August.
 
     Prosecutors say Rupp's son, Diezel, was riding on an ATV driven by a 6-year-old boy who crashed during a brief span when the boys were unsupervised. The ATV rolled and struck Diezel.
 
     Rupp's attorney, Charles Fife, argued that Rupp had left the boys with his girlfriend and the other boy's parents before the accident, which he said resulted from the boys disobeying their parents.
